Toothbrush Apartments - Terms of Business


This agreement is between Martin Pike, proprietor of Toothbrush Apartments (we, us, our, ours), and the hirer (you, your, yours).

Hire Period

You will have exclusive access to the apartment at a time to be agreed between 3pm to 9pm on the arrival day, and will vacate the apartment by 11am on the departure date. Arrivals after 9pm will be charged at £10 per hourly period, payable in cash on arrival. Departures beyond 11am will be charged at £20 per hourly period to cover our additional operating costs.

The Properties

You have had the opportunity to evaluate and question the suitability of the property in terms of its location and facilities for any specific requirements you may have. Any perceived issues or shortcomings must be reported to us immediately, so we can respond appropriately.

Conditions of Let

You acknowledge that this Agreement does not give rise to an assured shorthold tenancy or lease and is an excluded agreement within the meaning of s.3A(7)(a) of the Protection from Eviction Act 1977.


Our studio and one bed apartments may be occupied by a maximum of 2 people, our 2 bed apartments by a maximum of 4 people.  We do not accommodate (1) additional guests on sofas or air beds etc, (2) pets, (3) children under the age of ten without prior agreement. Please be clear that any children, of whatever age, are included in the ‘people’ numbers above. If you arrive with or later attempt to add additional people your booking will be terminated with immediate effect and no refund will be due.


In accordance with UK law, there is strictly no smoking whatsoever inside our apartments and the buildings within which they are contained. We reserve the right to charge the hirer for any consequential loss and additional cleaning charges for any apartment which cannot be immediately re-let.


Toothbrush Apartments trades under the VAT threshold and is not VAT registered.

Booking and Payment

No booking will be confirmed and therefore no contract exists until the amount due has been received by us.

A non refundable deposit of 25% is required to reserve dates, with full payment due a minimum of 14 days prior to the start of the period to which it pertains.

For longer term bookings we are happy to accept monthly payments, subject to the payment terms above.

If at any point throughout the duration of a booking payments to us fall behind, the booking will be deemed cancelled from the start of the period to which the late payment pertains and we will place the property back on general sale from that point.

We accept payment by Bank Transfer (BACS or PayM), cash, debit or credit card. Any cash paid into our bank by you is subject to a 1.5% surcharge, to cover our costs. Cash paid direct to us is not subject to a surcharge. Cheques are not accepted. Bank transfers from overseas to our bank account are charged at £10, to cover our costs.

Cancellation/Curtailment Policy

If you need to cancel or curtail your booking we require this in writing (email is acceptable). Please ensure that you receive our acknowledgement of the cancellation. Our cancellation terms are outlined in the table below: -

Notice Received

Charge (as % of total booking value)

> 2 weeks - 25% (we retain your deposit)

<=  2 weeks - 75% (25% refund)

< 1 week - 100% (no refund)

Should you wish to have more flexible cancellation/curtailment terms, please ask us for the relevant rates.

A curtailment of stay may result in a higher per night rate being applied, due to loss of a long term discount.

If the accommodation is unavailable on the booked dates due to events beyond our reasonable control we will take reasonable steps to find alternative accommodation up to and including the amount paid by you to us. If we are unable to do so, then all monies paid will be refunded. We will have no further liability to you or any other party.

Security Deposit / Liability for Damages and Loss

You will be required to pay a Security Deposit of £200, along with the final payment. This deposit is intended to cover any incidental damages and additional cleaning costs. This will be returned, in full or in part, as appropriate, by BACS transfer within 5 working days after departure.

Notwithstanding the above, you are responsible for the full cost of any damages and/or lost property, including keys and car park fob, howsoever caused, by you or anyone you have allowed into the property, and any resulting consequential loss to us.


We would recommend that you take out appropriate insurance to cover any costs you might incur if you have to cancel your booking or cause some accidental damage, as we do not provide any insurance under the terms of this agreement.

Personal Property / Security

Our apartments are in safe residential areas, but no-one is immune to crime. Personal property is your own responsibility. Please do not leave valuables in the apartment. Vehicles are left at your own risk.

The hirer is responsible for ensuring that our apartments are securely locked when not occupied during the booking.


In exceptional circumstances, we reserve the right to access our apartment at any point throughout your booking, should we deem it necessary.

Termination of Hire

Any breach of the above conditions may result in the immediate termination of your stay. Any refunds will be entirely at our discretion.

Agreement to these terms

You acknowledge that payment of any amount due will be deemed as acceptance of these terms.
